Terms and Conditions

GENERAL

We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website (see date at the bottom) and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.

If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you use this website.

PURCHASE

We accept payment by Visa, MasterCard, Switch, SOLO, UK Electron and Delta. Cheque payments can also be accepted. If this method of payment is preferred then your goods will not be despatched until we have cleared funds in our bank account. Cheques should be made payable to Expresslock (Europe) Ltd and sent to: Expresslock Limited 26 Coleshill Road Birmingham.B36.8AA. The currency applicable is Pounds Sterling in all cases. All prices are stated excluding VAT at the current rate. This rate may be subject to change from time to time depending on government policy. Credit card details will be handled securely to ensure confidentiality. Normally next working day to your order receipt, we will contact you to confirm the order details and take your card details or method of payment.

DELIVERY

We make every effort to keep our delivery charges as low as possible. Our charge depends on the type of product ordered and whether you choose standard delivery ( next working day) or a premium service.

Your order can be delivered to any address- your home, workplace or a neighbour's house, whichever is most convenient for you- just let us know when ordering.

Please note that a signature is required at the time of delivery for most orders.

Please make sure you give the correct address for the recipient. Additional charges will be made for redirection or for re-delivery due to postcode error.

Where the carrier is unable to find someone to accept delivery they will either deliver to a neighbour or leave a card at the address for the recipient to make contact.

If the recipient fails to make contact in good time the goods are returned to Expresslock (Europe) Ltd and a charge will be made for re-delivery to that or an alternative address.


Important: deliveries for next day must be placed before 12noon.

We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable due to unforeseen factors. Expresslock (Europe) Ltd shall be under no liability for any delay or failure to deliver the products within estimated timescales.

Cancellation

We operate a 'No Quibble' policy for cancellation to allow you a cooling off period after placing your order. You may cancel your order for any reason prior to despatch providing:-

You notify us of your cancellation in writing/e-mail within 24 hours of ordering.

After delivery - you must contact us prior to any return of goods. See Returns Sections below.

The goods remain unused and component parts are unopened.

Please note that unless the goods are faulty You will be responsible for the initial delivery and collection costs.

In addition to manufacturers' warranties we will offer a repair or replace, free of charge, any item that, through manufacturing defect, becomes unusable within 24 months of delivery.

No goods will be despatched between December 22nd and January 1st inclusive.

RETURNS POLICY

Purchases may be returned to us for a refund excluding delivery costs. Before returning any item, you must contact Expresslock (Europe) Ltd. You must return the goods within fourteen days of the receipt of your product/s.

Expresslock (Europe) Ltd will add a 20% re-stocking fee for goods returned deemed to be the customer's error.

Goods must be returned to Expresslock (Europe) Ltd. 26 Coleshill Road, Birmingham, B36.8AA. Only.

(You will be required to pay for the postage and packaging costs to return any items to us, Expresslock (Europe) Ltd will not refund the expense you incur in returning any of the products to us.)

In order to receive a refund, your purchase must be returned in as-new condition, in original packaging and with all manuals and accessories, including keys if any. We will not refund products that have been keyed alike unless of course there was a mistake on our part; this is also the case for any extra keys that have been ordered. Please be aware that keyed alike products may take longer to arrive than the standard delivery time.

Please allow 14 - 21 days from date of return for refunds to be processed and credited to your account.

Distance Selling Regulations

If you are contracting with us as a consumer, you have the right to cancel your contract at any time within 7 working days of receipt of the goods you ordered. In this case, you will receive a refund of the price paid for the goods, in accordance with our returns policy. To cancel a contract, you must inform us in writing and return the product(s) to us immediately, in the same condition in which you received it, and at your own cost and risk. The Regulations do not apply to special orders, such as keyed alike goods, master keyed systems and extra keys.

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of this website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.

You acknowledge and agree that the material and content contained within this website is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using this website. You further acknowledge that any other use of the material and content of this website is strictly prohibited and you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

Trade Account Customers

Full Payment is required within 28 days of purchase. If you have not settled your account within 28 days we may add interest to your order, your account will be placed on stop and a reminder letter will be sent. If we still do not receive payment after a reminder letter has been received then you will receive a final warning letter of which a copy will be sent to our collection agency.

You may at any time in writing ask for your credit limit to be increased, this will be reviewed by our credit control team.

Any 3rd party delivery will require an email or fax sent to us for authorisation.


Liability and Indemnity

Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability, which may not otherwise be limited or excluded under applicable law.

Expresslock (Europe) Ltd will use reasonable endeavours to verify the accuracy of any information on the site but makes no representation or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website Expresslock (Europe) Ltd will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and Expresslock (Europe) Ltd accepts no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.

Subject to above, other than as expressly provided in these terms and conditions with respect to specific products and except for the exclusive remedies set out in the section above, any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under applicable law.

Expresslock (Europe) Ltd will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any:

Economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or loss of goodwill or reputation; or special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.

Notwithstanding the above, subject to Section Above Expresslock (Europe) Ltd aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same clause.

This clause 7 does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.

We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
